Nalvina Online-Shop – General Terms and Conditions (GTC)
These conditions of sale apply to any supply of Nadielle S.à.r.l. (Nalvina) products to you, listed on the website http://nalvina.com. Please read these conditions of sale carefully before ordering any products from this website. Nalvina accepts contrary conditions of sale only if expressly consented to. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions as set out below.
1. Conclusion of contract/Purchase of goods
All presentation of products in Nalvina´s Online Shop is a non-committal invitation to make an offer to purchase products from Nalvina.
Your order for a product shall be regarded as an offer to purchase products under these conditions of sale.
After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. We will accept your offer confirm by sending the purchased product through our supplier.
Nalvina is free to not accept an order. If Nalvina does not accept an order, we will notify you by email. Nalvina only sells goods in customary amount.
2. Delivery
Delivery will be carried out by our respective supplier to the given address of the recipient of your order. To ensure punctual delivery, we ask you to check recipient´s address carefully before you submit your order.
Generally, delivery is carried out on the required date, exceptionally on Sundays and official holidays. In case that we notice that the product you ordered is unexpectedly not available, Nalvina will inform you separately via email.
3. Price and Payment
Except where noted otherwise, the prices displayed for products on our website represent the full retail price listed on the product itself inclusive of VAT at the current rates. Delivery costs will be added to the total amount due as displayed separately in the process of your order.
Total price and costs will be displayed to you before your final order.
All costs are displayed in EURO.
Payment can be made by credit card and by Pay Pal as detailed in the ordering process. A payment method shall remain excluded after a credit assessment failure.
We will display the price that you have to pay on the confirmation of the receipt of your order. Payment must be made before supply of the products.
In case you wish to pay with your credit card, Nalvina will authorize the total price on your credit card, but not charge it until we dispatch your order.
We may suspend delivery of the products until full payment is received. We may terminate the contract between you and us with immediate written notice if you fail, without good reason, to pay on time. All card holders are subject to validation checks and authorization by the card issuer. We may share the credit card holder's personal information with such third parties as are necessary to enable us to do such checks. If the issuer of the credit card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.
Ownership of the products will pass to you upon the later of receipt by us of full payment of all sums due in respect of the products (including delivery charges) or delivery to you of the products.
We may recover any products supplied at any time prior to ownership passing if you are in breach of these conditions of sale.
Risk of the products passes to you upon delivery. Risk in the sense of this provision means the responsibility for damage caused to or by use, handling or storage of the products.
In case that one of our suppliers does not deliver the ordered products contrary to contractual obligation and if this leads to an enduring impediment to performance, Nalvina is permitted to withdraw from the contract between you and Nalvina. In this case of withdrawal, Nalvina will inform you promptly and will repay you.
4. Adjustment and Cancellation of your order
With an adjustment or cancellation of your order, certain additional costs – Nalvina will inform you prior about - may occur.
5. Warranty
Statutory regulations of Switzerland apply, if not agreed upon differently.
6. Minimum age
By placing an order through Nalvina´s Online Shop, you warrant that you are legally capable of entering into binding contracts and this GTC and you and the recipient of your order are at least 18 years old and permitted to buy and consume alcoholic products.
You take over all responsibility for all kind of order or other legally relevant action that is taken in your name and with aid of your credit card or another paying method, if the action was undertaken by an under- or full-aged member of your household. Furthermore, you guarantee that all information that is stated by you (or by any member of your household) in the usage of this website is veridical.

10. Miscellaneous
Agreements for the purchase of products through this website and Nalvina´s GTC shall be interpreted and governed in accordance with Swiss law. There will be no application of UN Convention on Contracts for the International Sale of Goods (CISG).
Lausanne, Switzerland, shall be the exclusive place of jurisdiction in respect of any dispute arising from contract between you and Nalvina and these GTC. Nalvina shall also be permitted to choose the residence of the customer as the place of jurisdiction.
If any part of these terms and conditions or any provisions of an Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law these GTC.
